About these terms

These terms apply when you use FormedEasy ("FormedEasy", "we", "us"), provided by FormedEasy. By creating an account or using the service, you agree to them. If you are using FormedEasy for a business, you confirm you can agree to these terms on its behalf.

Our Privacy Policy explains how we handle personal data and forms part of these terms.

The service

FormedEasy crawls the websites you choose, checks their pages against a set of technical SEO rules, and gives you a score, a prioritised list of issues, comparisons between audits and downloadable reports. You can also import reports from other tools.

We also design, build and host websites. Those projects are covered by the web design, development and hosting section below, together with the written quote or proposal we agree with you.

Scores and recommendations are guidance based on automated checks. They are not a guarantee of search rankings, traffic or results, and search engines may assess your website differently. Use your own judgement before making changes to a website.

Your account

• You must be at least 16 years old to create an account.
• Give accurate details and keep your email address up to date.
• Keep your password secure and do not share your account. You are responsible for what happens under it.
• Tell us straight away at hello@formedeasy.com if you think someone else has access to your account.

Acceptable use

Only audit websites you own, manage, or otherwise have a legitimate reason to check. You must not use FormedEasy to:

• overload, disrupt or attack any website or service, including ours;
• get around security measures, access non-public areas, or crawl websites that have asked not to be crawled for an unlawful purpose;
• collect personal data from websites in breach of data protection law;
• break the law, infringe anyone's rights, or resell or copy the service without our written permission;
• reverse engineer the service or interfere with how it works.

We apply limits on how many audits can run and how large they can be, to keep the service fair and to be considerate to the websites being crawled. We may suspend audits or accounts that break these rules.

Plans and payment

You can use FormedEasy on the free plan, or buy a paid plan for more audits, larger crawls and extra features. Each plan's price, billing period and limits are shown on our pricing page and when you buy, and those apply to you.

• Payments are taken by our payment provider, Stripe. You authorise us to charge your chosen payment method at the start of each billing period.
• Paid plans renew automatically each month or year until you cancel. You can cancel at any time from Plan and billing; you keep your plan until the end of the period you have paid for, and you will not be charged again.
• If you switch plans part-way through a period, the change is prorated: you are credited for the unused part of your old plan and charged for the rest of the new one.
• Monthly audit allowances reset on the 1st of each month (UK time, GMT) and unused audits do not roll over.
• If a payment fails, we may move your account to the free plan until it is paid. Your reports are kept.
• We may change our prices. Changes never apply to a period you have already paid for, and we will tell you before a new price applies to your plan.

Payments are not refundable for partly used periods, except where the law says otherwise. Nothing in these terms affects your statutory rights as a consumer.

Web design, development and hosting

Sending an enquiry from our web design page does not create a contract or commit you to anything. If you go ahead, we will send you a written quote or proposal setting out the work, the price, the payment schedule and the timescale. Once you accept it, that document and these terms together form our agreement for the project. If the two conflict, the quote or proposal wins.

• Your content. You are responsible for the text, images, logos and other material you give us, and you confirm you have the right to use them. We are not responsible for delays caused by content or feedback arriving late.
• Changes. Work outside the agreed scope, or changes after you have approved a stage, may cost extra. We will tell you the cost and get your agreement before doing it.
• Ownership. Once you have paid in full, you own the finished website's design and the content made specifically for you. We keep ownership of our own general tools, code and know-how, and you get a permanent licence to use them as part of your website. We may show the finished website in our portfolio unless you ask us not to.
• Hosting and care. If we host or look after your website, what is included, the price and the notice period are set out in your agreement. Hosting renews until either of us ends it with that notice. When it ends, we will help you move your website elsewhere, provided all invoices are paid.
• Search results. We build websites to follow good technical SEO practice, but we cannot guarantee any search ranking, traffic or enquiries.

Your data and reports

You keep all rights in the information you give us and in your reports. You give us permission to store and process it only as needed to provide the service. You can export reports as CSV files and delete them, or your whole account, at any time.

Our intellectual property

The FormedEasy name, website, software, design and content belong to us or our licensors. You may use the service and your reports for your own and your clients' purposes, but you may not copy or reuse the service itself.

FormedEasy is not affiliated with or endorsed by Screaming Frog Ltd. "Screaming Frog" and "SEO Spider" are trademarks of their respective owner and are mentioned only to describe compatible file formats.

Availability and changes

We work to keep FormedEasy running smoothly, but we cannot promise it will always be available or error-free, and audits can be affected by the websites being crawled. We may change, improve or remove features. If we make a change that significantly affects a paid plan, we will tell you in advance.

We may update these terms. We will show the date of the latest version at the top of this page and tell you about significant changes before they take effect. If you keep using the service after that, the new terms apply.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Otherwise, to the extent the law allows:

• we are not liable for indirect or consequential losses, or for loss of profits, revenue, rankings, traffic, data or goodwill;
• we are not responsible for changes you make to a website based on the service's recommendations;
• our total liability to you in any 12-month period is limited to the amount you paid us in that period, or £100 if you have not paid us anything.

Ending your use

You can stop using FormedEasy and delete your account at any time from Settings. We may suspend or close your account if you seriously or repeatedly break these terms, or if we stop providing the service — where we can, we will give you notice and a chance to export your reports first.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK as a consumer, you may also bring claims in your local courts.
